Privacy Policy

This privacy policy and agreement (the “Privacy Policy” or “Policy”) explains how, with your permission, CultureHQ, Inc. (“CULTUREHQ”, “we” or “us”) collects, uses and treats information that we receive from you through our web and mobile app (available at www.culturehq.com and platform.culturehq.com) (together, the “Application”). The terms “you” and “your” refer to any person or entity providing us with Personal Information through our Application. For your convenience, Section 13 (Definitions) provides definitions used in this Privacy Policy. This Policy does not cover Personal Information provided through other means, such as telephone calls and traditional mailings.

2. Types of Information You May Provide

Information we collect falls into two categories: (i) Anonymous Information, and (ii) Personal Information.

2.1. Anonymous Information means information that does not identify you individually, such as statistical information concerning the pages you visit most frequently.

2.2. Personal Information means information that would allow us (or others) to identify and contact you including: (i) your name; (ii) mailing address; (iii) telephone number; (iv) financial account information; (v) email address; and (vi) other similar information. On our Application, Personal Information is collected from your profile, including name, email, job position, department, location, and personal interests and skills.

3. Our Uses of Your Personal Information

You decide whether to provide us with Personal Information. As a data controller, we collect information when your profile is created, when you post to the Application, sign up for our demo or newsletter, engage with us on social media, or reach out digitally, by phone, or in person. We keep your Personal Information as long as necessary to fulfill collection purposes, including legal, accounting, or reporting requirements.

3.1. Messaging. Used when you reach out through our chat feature to identify who you are so we may better assist you.

3.2. Announcements and Updates. Proactive communications such as updates and notifications sent via email or instant message. You may unsubscribe at any time.

3.3. Automated Notifications. Email notifications to keep Members aware of relevant content. You may opt out through your profile page.

3.4. Personalizing Your Experience. Cookies recognize you when you return. See Section 7.2 for details.

3.5. Promotions. We may post endorsements or descriptions of your experiences. We will first obtain your permission.

3.6. Submitted Content. We may collect Personal Information when you provide Submitted Content for posting. See Section 4.

4. Submitted Content

Personal Information included with Submitted Content will be treated as Submitted Content, not as Personal Information. Your organization may post your Submitted Content on their marketing website, job listings, or social media. Such information is not subject to this Privacy Policy.

4.1. Administrator Use of Content. Your organization’s administrators may select content you posted to share externally. Contact your administrators if you prefer specific content not be shared.

5. Posted Content

You may post information that includes Personal Information (e.g., posts in an event feed). These posts may be viewed by other Members in your company and, for shared events, by Members of those parties.

6. Disclosures to Third Parties

We will not disclose Personal Information to third parties without your express consent, except:

6.1. Vendors. We employ data processors to perform functions on our behalf, providing only necessary Personal Information. Vendors include Intercom (communication), SendGrid (transactional emails), and Amazon Web Services (encrypted database storage).

6.2. Questions of Harm. We may disclose Personal Information if we believe you are at risk of harm, harming others, or violating our policies or legal obligations.

6.3. Legal. We will reveal Personal Information to the extent required by law. We may attempt to notify you via email before responding to legal process, unless notification is not permitted.

6.4. Transfer of Ownership. We may transfer Personal Information in connection with a sale of all or substantially all assets, provided the acquirer agrees to safeguard your information with equal or greater protections.

7. Our Use of Anonymous Information

We use Anonymous Information to analyze and improve our Application. We may share Anonymous Information with third parties; it will not allow anyone to identify you.

7.1. IP Addresses; Logs. We may automatically receive information from your browser including IP address, computer name, browser type, and referrer addresses for usage analysis and security monitoring.

7.2. Cookies. Small data files stored on your computer to recognize you on return visits. You may disable cookies in your browser, though some personalized features require them.

7.3. Tags. We may use pixel tags (web beacons) to measure which parts of our Application are visited and whether emails are opened. This data does not include Personal Information.

7.4. Click-Throughs. Emails may use click-through URLs to measure interest and communication effectiveness. To avoid tracking, do not click email links or notify us per Section 9.

8. Anonymous Information Linked with Personal Information

We may link Personal Information with Anonymous Information (“Linked Information”). Linked Information will be treated and protected as Personal Information under this Policy.

9. Opting Out

You may opt out of bulletins, notifications, Alerts, and other communications. You will not be allowed to opt out of formal notices concerning the operation of our Application. To opt out, email us at data@culturehq.com.

10. Access; Removing Personal Information

You can request that we change, update, or delete your Personal Information, request a copy, or object to processing. We will verify your identity before fulfilling requests. If you request deletion, you will be unable to use associated services. Email data@culturehq.com to exercise these rights. We will fulfill requests within 30 days, barring legal conflicts.

11. Third-Party Sites

Our Application may contain links to other sites. We are not responsible for the privacy practices of other sites and encourage you to read their privacy policies. This Policy applies solely to information collected on our Application.

12. Security

We have put in place security systems, physical and technical safeguards, and quality controls to prevent unauthorized access to Personal Information. You also play a key role—guard your password, close your browser when finished, and use the “Security” tab on your profile page to log out of active sessions.

13. Definitions

13.1. Affiliate. An entity controlling, controlled by, or under common control with CULTUREHQ (ownership of >50% voting rights or ability to control day-to-day operations).

13.2. Anonymous Information. Defined in Section 2.1.

13.3. Other Policies. Defined in our Terms of Use.

13.4. Personal Information. Defined in Section 2.2.

13.5. CULTUREHQ Member. Application visitors who registered as Members on our website or through their company.

13.6. Submitted Content. Defined in our Terms of Use.

14. Additional General Provisions

14.1. Privacy Protection for Children. Our Application is not directed at children. We will not accept Personal Information from individuals under 13. Per COPPA, if we learn a child under 13 has provided Personal Information, we will delete it or obtain verifiable parental consent.

14.2. Changes to Our Privacy Policy. We may change this Policy from time to time and will inform you of changes. Changes become effective upon your consent pursuant to Section 1.

14.3. Disclaimer Notice. We make no claims, promises, or guarantees about the accuracy, completeness, or adequacy of Application content. No warranty of any kind is given with respect to the Application or its products and services.

14.4. Application Privileges. You agree to refrain from activity that imposes an unreasonable burden on the Application. We reserve the right to limit access of any user violating this Policy.

14.5. Choice of Law. This Policy shall be construed under the laws of the Commonwealth of Massachusetts. Disputes shall be resolved exclusively by courts in the judicial district including Boston, Massachusetts.
